Terms and Conditions – Carib Wedding

These documents constitute a single reference including:

  • PART I – TERMS OF USE (TOU), applicable to all users of the Carib Wedding website;
  • PART II – TERMS OF SALE (TCoS), applicable exclusively to service providers  subscribing to a paid plan.

Each user is invited to read the provisions that apply to them.

PART I – TERMS OF USE (TOU)

1. Website Overview

The Carib Wedding website is a platform dedicated to organizing weddings in the Caribbean. It allows engaged couples to discover and connect with wedding “service providers” (hereinafter referred to as “Providers”) operating in this region.

The site also provides editorial articles related to wedding planning, testimonials, practical advice, and information about listed providers.

Access to the site is free and open to all. Certain features, such as newsletter subscription or interaction with content, may require registration.

2. Acceptance of the Terms of Use

By accessing and using the Carib Wedding website, the user acknowledges having read these TOU and accepts them without reservation.

If the user does not accept all or part of these terms, they are invited not to use the site.

3. Modification of the TOU

Carib Wedding reserves the right to modify, at any time, these Terms of Use.

Users are encouraged to consult this page regularly to stay informed of possible changes. Continued use of the site after modification constitutes acceptance of the updated TOU.

4. Access to the Website and Services

Access to the Carib Wedding website is free. Users may consult all content without registration.

Users may also subscribe to the newsletter to receive information, editorial updates, and partner offers.

4.1 Becoming a Member of Carib Wedding

To participate in site activities and interact with content (comments, community features), users may register for free as a member.

There are two categories of members:

  • User / Member: allows participation in site activities, interaction with articles, leaving reviews for vendors, and access to features intended for engaged couples.
  • Provider / Vendor: allows participation in site activities and access to offers dedicated to wedding professionals.

During registration, users must provide a username, a valid email address, and a password. Registration implies compliance with the behavior rules defined in these TOU.

4.2 “Exclusive Benefit for Carib Wedding Member” Label

Certain providers may display on their page a label “Exclusive Benefit for Carib Wedding Member”, indicating that a specific benefit is offered to members (discount, gift, special attention, etc.).

To benefit, the user must:

  • be registered on the Carib Wedding website;
  • mention their Carib Wedding membership when contacting the provider and before signing any contract.

The benefit is granted solely at the provider’s responsibility, according to their own terms. Carib Wedding cannot be held responsible for the nature, availability, or application of the benefit offered.

4.3 Plans for Providers

Carib Wedding offers the following plans to providers:

  • Essential Plan, free under certain conditions, allowing listing in the directory with vendor name, one service category, one location, and phone number;
  • Paid visibility plans, granting enhanced visibility with additional features.

Specific conditions for these plans are detailed in PART II – TCoS for paid plans and in Article 5 for the Essential plan.

5. TOU Specific to the “Essential” Plan

5.1 Registration Conditions

The Essential plan allows free listing of wedding professionals operating in the Caribbean. Registration is conditional upon commitments on Carib Wedding’s social media.

5.2 Social Media Commitments

Providers benefiting from the Essential plan agree to actively participate in Carib Wedding’s social media publications (Instagram, Facebook), including regular actions such as likes, shares, and comments.

Failure to comply may result in removal of the provider’s profile from the directory, without notice or compensation.

5.3 Platform Responsibility

Carib Wedding provides a directory solely to facilitate connections between engaged couples and providers.

The platform does not guarantee the quality, availability, or effectiveness of services offered and does not commit to providing clients or business opportunities to listed providers.

5.4 Modification and Suspension of the Directory

Carib Wedding reserves the right to modify participation criteria, suspend, or terminate the directory at any time, without notice.

5.5 Duration of Registration

Registration under the Essential plan remains valid as long as the provider complies with these TOU.

In case of breach, Carib Wedding may suspend or remove the registration without notice or compensation.

6. Provider Quality Charter – Carib Wedding

All providers listed on Carib Wedding agree to adopt a professional approach based on service quality, respect for engaged couples, and the trusted image of the platform.

6.1 Quality Commitment

The provider agrees to deliver services in accordance with professional standards, with diligence, transparency, and good faith.

6.2 Respect for Engaged Couples

The provider agrees to:

  • communicate clearly, honestly, and respectfully;
  • honor commitments (services, deadlines, announced conditions);
  • maintain professional conduct before, during, and after the service.

6.3 Transparency of Information

The provider must provide accurate, truthful, and up-to-date information regarding their services, locations, and service conditions.

6.4 Carib Wedding Image and Values

The provider agrees to positively represent Carib Wedding, not to damage its image, and to use its name, logo, or badge fairly and truthfully.

6.5 Customer Reviews

The provider accepts customer reviews and agrees not to engage in fraudulent or misleading practices regarding evaluations.

6.6 Breach of the Charter

In case of conduct contrary to this charter, Carib Wedding reserves the right to suspend or remove the provider’s listing without notice or compensation.

6.7 Acceptance

Registration or continued listing on the platform constitutes agreement to comply with this Quality Charter.

7. Platform Liability

The Carib Wedding site provides only information and guidance on wedding planning. While we strive to publish quality content, we do not guarantee the accuracy, relevance, or timeliness of the information provided.

Under no circumstances shall Carib Wedding be held responsible for decisions made by users based on site information.

Carib Wedding also provides a directory of providers but disclaims any responsibility regarding the quality, availability, or pricing of services offered. The platform’s role is limited to connecting users and providing information.

Each Provider listed on the platform is solely responsible for complying with the legal, regulatory, tax and immigration requirements applicable to their activity in the jurisdictions where they provide services. While Carib Wedding may perform certain checks, it does not guarantee or certify the legal status, licenses, or authorizations of Providers.

Carib Wedding is not a party to any agreement entered into between users and Providers.

Carib Wedding also disclaims any responsibility in the event of interruption, malfunction, maintenance, or bugs on the site, and any inconvenience that may result for users and providers.

8. User Conduct

Users agree to use the site legally, responsibly, and respectfully.

The following are prohibited:

  • defamatory, hateful, discriminatory, or offensive content;
  • spam or unsolicited advertising;
  • harassment;
  • sharing personal data without consent;
  • any illegal or immoral activity.

Carib Wedding reserves the right to remove any non-compliant content and suspend access for repeated violations.

9. Intellectual Property

All content published on Carib Wedding, including articles, images, videos, logos, and other graphical elements, is protected by intellectual property rights.

Users agree not to reproduce, distribute, or exploit these contents without CARIB AGENCY’s prior authorization.

Users may share blog articles via social media features, but may not reproduce or publish content without explicit permission.

10. Personal Data

Personal data are collected and processed in accordance with applicable regulations, including GDPR. Details are provided in the Privacy Policy.

11. Governing Law and Disputes

These TOU are governed by French law, subject to specific rules applicable to the territory of Saint Martin.

In the event of a dispute relating to site use or TOU interpretation, the competent courts shall be those of Saint Martin.

Mediation may be considered before any legal action.

PART II – TERMS OF SALE (TCoS)

Only “service providers” (hereinafter referred to as “Providers”) who meet the following criteria may subscribe to a paid plan on the Carib Wedding platform:

• have a business establishment in the Caribbean, or

• demonstrate regular professional activity in the Caribbean wedding market.

These Terms of Sale apply exclusively to such Providers.

1. Description of Services

Carib Wedding provides an online directory of wedding service providers in the Caribbean. Each provider benefits from a dedicated page, the content of which varies depending on the subscribed plan.

Elegance Plan:

  • Vendor name
  • Service category(ies) (up to 2)
  • Phone number
  • Email address
  • Links to Instagram, Facebook, WhatsApp
  • Slogan / tagline and provider description
  • Languages spoken
  • Business hours
  • On request: possibility of obtaining a Carib Wedding Directory badge for the provider’s website
  • Image gallery (up to 10 photos)
  • 1 location / destination

Prestige Plan:

  • Vendor name
  • Service category(ies) (up to 2)
  • Phone number
  • Email address
  • Links to Instagram, Facebook, WhatsApp
  • Slogan / tagline and provider description
  • Languages spoken
  • Business hours
  • On request: possibility of obtaining a Carib Wedding Directory badge for the provider’s website
  • Image gallery (up to 10 photos)
  • Up to 2 locations / destinations
  • Vendor website link
  • Services offered
  • Pricing
  • Customer reviews and ratings on Carib Wedding

Excellence Plan:

  • Vendor name
  • Service category(ies) (up to 2)
  • Phone number
  • Email address
  • Links to Instagram, Facebook, WhatsApp
  • Slogan / tagline and provider description
  • Languages spoken
  • Business hours
  • On request: possibility of obtaining a Carib Wedding Directory badge for the provider’s website
  • Image gallery (up to 20 photos)
  • Up to 4 locations / destinations
  • Vendor website link
  • Services offered
  • Pricing
  • Customer reviews and ratings on Carib Wedding
  • Presentation video (YouTube URL)
  • Priority support for page modifications

Note: The exact features accessible depend on the subscribed plan and are described in the Vendors Area during subscription.

2. Pricing

The offered plans are as follows:

  • Monthly Elegance / Prestige plans: recurring monthly payment via the secure platform.
  • Annual Elegance / Prestige / Excellence plans: one-time annual payment, automatically renewable. The annual plan is valid for 12 months and provides savings equivalent to two months compared to the monthly subscription, except for the Excellence plan, which is only available as an annual plan.

Prices are displayed excluding taxes. Prices are subject to change, without loss of benefits for already subscribed providers, except in the event of subscription interruption.

VAT not applicable – business established in Saint Martin. Depending on the provider’s location and tax status, they may be required to self-assess VAT or any equivalent tax applicable in their territory.

3. Payment and Penalties

All payments are made via the secure platform on Carib Wedding.

  • Payments are recurring, either monthly or annually, depending on the chosen subscription.
  • In the event of failed or late payment, Carib Wedding reserves the right to:
    • temporarily suspend access to or visibility of the provider’s page;
    • apply late penalties at a rate of three times the legal interest rate in force;
    • require a fixed indemnity of €40 for recovery costs, in accordance with Article L441-10 of the French Commercial Code.

4. Termination

4.1 Monthly Elegance / Prestige Plans

  • Automatically renewed each month.
  • Termination must be done via the Vendors Area, under “Manage my subscription” → “Cancel subscription”.
  • No prorated refunds will be granted.

4.2 Annual Elegance / Prestige / Excellence Plans

  • Automatically renewed each year.
  • Termination must be done via the Vendors Area, under “Manage my subscription” → “Cancel subscription”.
  • No prorated refunds will be granted.

5. Uploading the Dedicated Page

  • After payment, a form is made available to the provider to collect the information necessary to create their dedicated page. This form remains accessible in the Vendors Area under “Manage my subscription” → “Add listing
  • The information provided serves as the basis for creating the page. Carib Wedding allows adjustments to optimize the page, but modifications are not unlimited.
  • Once payment and the completed form are received, the page will be published within a maximum of 7 business days.

6. Provider Commitments

The provider agrees to:

  • provide accurate, truthful, and up-to-date information;
  • comply with platform rules and applicable legislation;
  • not publish misleading, false, or illegal content.

In case of breach, Carib Wedding reserves the right to suspend or remove the dedicated page, without refund or compensation.

7. Referral Program

Carib Wedding offers a referral program allowing providers to benefit from exclusive advantages by recommending the platform to new members.

7.1 Referrer Conditions

  • Must have an active annual subscription.
  • Request a referral code via email or through the Vendors Area.
  • The code is issued after validation by Carib Wedding.

7.2 Referee Conditions

  • Must be a new provider who has never been registered on Carib Wedding;
  • Subscribe to an annual plan using the referral code at payment;
  • Contact Carib Wedding before payment in case of difficulties related to the code.

The referee receives a 10% discount on the annual plan, valid only for the first year. Only one code is allowed per person, and offers are not cumulative.

7.3 Referrer Reward

After three paying referees subscribing to an annual plan, the referrer receives a one-year subscription extension, cumulative up to a maximum of two years. This benefit cannot be converted into cash or refunded.

7.4 Timing and Fraud Prevention

The extension is granted within 15 days following validation of payments from the three referees.
Any abuse, fake account, or attempt to circumvent the rules will result in cancellation of the referral, and Carib Wedding’s decisions are final.

8. “Exclusive Benefit for Carib Wedding Member” Label

Providers may indicate on their page that they offer a benefit (discount, gift, special attention, etc.) to Carib Wedding members. Members must mention their membership before signing any contract.

The granting of the benefit, its nature, and terms are at the provider’s discretion.

Activation or deactivation of this benefit can be requested by email. Removal will be effective within a reasonable period after receipt of the request.

Carib Wedding acts solely as an intermediary in connecting members with providers and cannot be held responsible for disputes regarding the benefit’s application or availability.

9. Rights and Responsibilities of Carib Wedding

Carib Wedding is a connecting platform and does not intervene in contractual relations between users and providers.

Carib Wedding does not guarantee the quality of services offered and cannot be held responsible for any dispute between a user and a provider.

Carib Wedding does not guarantee any volume of clients or specific placement in the directory. The order of providers may be influenced, among other factors, by the number of views or customer reviews.

In the event of non-compliance with these Terms of Sale, Carib Wedding reserves the right to suspend or remove the provider’s page without notice or compensation.

The term “Carib Wedding” refers interchangeably to the website and the company CARIB AGENCY.

10. Intellectual Property

All content published on Carib Wedding (texts, images, videos, logos) is protected by intellectual property law. Any reproduction without prior authorization is prohibited.

11. Personal Data

Personal data are collected and processed in accordance with the General Data Protection Regulation (GDPR). Full details are provided in the Privacy Policy.

12. Governing Law and Disputes

These Terms of Sale are governed by French law. The competent courts are those of Saint Martin. Mediation may be considered before any legal action.
